Short Term Rental Agreement

These Terms and Conditions ("Terms") govern your use of the website hostbnb.ca (the "Site") and any booking of short-term rentals through Hostbnb Inc. ("we", "us", or "our"). By making a booking or using our services, you agree to comply with and be bound by these Terms. Please read them carefully.

Booking and Payment

Booking Confirmation: A booking is confirmed when we receive full payment and you receive a confirmation email. Until confirmed, availability and rates may change without notice.

Payment Terms: Full payment must be made at the time of booking. We accept payments via credit card.

Pricing: Prices listed on our website are subject to change. Once a booking is confirmed, the price will not change unless you modify the booking.

The Guest is authorized to occupy the Premises based on the agreed arrival and departure dates as listed above.

Quiet Hours

Quiet hours are from 10:00 PM to 8:00 AM. During this time, no music should be played, and all audio should be kept at a minimum to respect neighbouring residents.

Occupants

The total number of individuals staying on the Premises during the Lease Term shall not exceed the number of guests booked.

The person booking the property must be 18 years or older and must be present for the duration of the rental.

The Guest must notify the Host of any changes to the occupancy list.

Failure to comply with the occupancy limit or any unauthorized guests may result in termination of this Agreement.

Booking Fees

The Guest shall pay the amount specified during the booking process, inclusive of applicable HST (13%).

Pets

Pets may or may not be permitted at your selected property. Please check the listing details in advance of booking to ensure pets are permitted. 

For pet friendly rentals, a $50 pet fee is required for additional cleaning.

Any damage caused by pets is the Guest’s responsibility.

Pets must be included in the reservation at the time of booking.

Smoking Policy

Smoking and vaping are strictly prohibited inside the Premises.

Guests who wish to smoke or vape must do so outside and are responsible for properly disposing of all smoking materials and ensuring that no litter or cigarette butts are left on the property.

Any evidence of smoking or vaping inside, or failure to clean up properly outside, may result in additional cleaning charges and deductions from the security deposit.

Subletting

Subletting the Premises is not permitted.

Inspection and Termination

The Guest agrees to allow entry by the Host, local authorities, or municipal licensing officers for reasons such as noise violations, occupancy issues, or other reasonable causes.

If the Guest violates any terms of this Agreement, the rental period may be terminated immediately in accordance with provincial law.

The Guest agrees to vacate the Premises at the end of the rental period and waives all rights to legal action if they fail to do so.

Maintenance and Repairs

The Guest agrees to maintain the Premises in a clean and habitable condition and use it responsibly.

The Guest shall leave the Premises in a ready-to-rent condition.

The Host reserves the right to deduct costs for repairs and maintenance from the Security Hold on the guests credit card if the Premises are left in poor condition.

Cleaning

A cleaning fee is charged at the time of booking to cover standard cleaning.

Any additional cleaning required due to excessive mess or neglect will be deducted from the damage deposit at an hourly rate of $45 per hour.

Trash

The Guest must dispose of all waste materials according to the Host’s instructions.

Quiet Enjoyment

The Guest must conduct themselves in a respectful manner and avoid creating disturbances. Large gatherings or parties are grounds for immediate termination of this Agreement.

Host’s Liability

The Host is not liable for any personal injury, death, or property damage arising from the use of the Premises.

The Host’s insurance does not cover the Guest’s personal property.

The Guest is encouraged to purchase their own travel insurance for personal belongings and any potential liabilities.

Security Hold for Damages and Cleaning

A $500 security hold will be placed on the guest’s credit card 3 days prior to check-in. This is a pre-authorization only and no funds will be charged unless damage or excessive cleaning is identified after check-out.

If no issues are found, the hold will be automatically released within 7 days of departure, depending on your bank’s processing time.

If damages or cleaning fees exceed $500, the guest’s credit card on file will be charged for the additional amount. A detailed invoice will be provided for any charges applied.

Short-Term Rental

The Guest acknowledges that this Agreement is for a short-term rental and cannot establish long-term tenancy. The Guest agrees to vacate the Premises on the agreed departure date.

Lawyer Fees

The Guest agrees to cover all reasonable costs, including lawyer fees, incurred by the Host in enforcing this Agreement.

Use of Premises

The Premises are for residential use only. The Guest is not permitted to conduct any commercial activities or sell products/services on the Premises.

Illegal Activity

The Guest must use the Premises for lawful purposes only. Any illegal activities, including drug use or abusive behavior, will result in immediate termination of this Agreement with no refund.

Possessions

The Host is not responsible for any personal items left on the Premises. Efforts will be made to return such items, but if not claimed within two (2) weeks, the Host may keep or dispose of them.

Equipment and Injuries

The Host is not liable for any injuries or deaths resulting from the use of equipment or amenities on the Premises, including but not limited to kayaks, BBQs, bikes, canoes, kids' toys, or the fireplace. The Guest assumes all risks associated with using these items.

Payment Schedule & Cancellation Policy

Payment Schedule

Full Payment: Due at the time of booking, including applicable HST (13%).

Security Hold: $500 security hold placed on credit card 3 days prior to check-in. This is a pre-authorization only and no funds will be charged unless damage or excessive cleaning is identified after check-out. 

Additional Charges: Should the cost of damages or extra cleaning exceed $500, the guest’s credit card on file will be charged for the difference. An invoice with a detailed breakdown of the charges will be provided.

Cancellation Policy

100% Refund: For cancellations made 30 days or more before the check-in date.

50% Refund: For cancellations made between 15 and 29 days before the check-in date.

No Refund: For cancellations made 14 days or fewer before the check-in date.

Exceptions to the Cancellation Policy

We understand that unforeseen circumstances can arise. While our cancellation policy is firm, we may offer a full or partial refund outside of the standard terms under the following exceptional circumstances, provided appropriate documentation is submitted:

Serious Illness or Injury: If the guest or an immediate family member is hospitalized or experiences a serious medical emergency that prevents travel.

Death in the Immediate Family: Including parent, child, spouse, sibling, or grandparent.

Natural Disasters or Severe Weather: If a named event (e.g., tornado, flood, wildfire, blizzard) renders the property inaccessible or unsafe during the guest's stay. Severe weather forecasts alone do not qualify.

Government-Issued Travel Restrictions: If a local or national government bans travel due to pandemic, war, or other large-scale emergency.

Flight or Border Closure: If a guest cannot reach the property due to border shutdowns, grounded flights, or closed highways caused by uncontrollable events.

Required Documentation: All exceptions must be supported with verifiable documentation (e.g., hospital note, obituary, travel advisory notice, government-issued announcement, etc.). We reserve the right to assess each claim on a case-by-case basis and determine whether an exception applies.

Travel Insurance Recommendation: We strongly recommend that guests purchase comprehensive travel insurance to protect against unforeseen events that may lead to cancellation.

Compliance with Local Bylaws

The Guest agrees to comply with all local bylaws and regulations pertaining to fire safety, noise, waste disposal, and fireworks as specified by the municipality in which the Premises is located.

Non-compliance may result in fines, penalties, or immediate termination of this Agreement without refund.
